The interplay between the Americans with Disabilities Act (ADA), COVID-19, and pre-existing health conditions has become a hot topic in employment law. The wave of COVID-19 workplace lawsuits has already begun.  In what is looking like a potential tsunami, employers need to understand the interplay of these topics to prevent, prepare for, and if necessary, defend the waterfall of EEOC charges and lawsuits that may be coming their way.  During this interactive webinar, we will discuss guidance from the Equal Employment Opportunity Commission (EEOC) on the ADA, what triggers the duty to engage in the “interactive process,” how to manage requests for “reasonable accommodations” (e.g., work-at-home, protected leave, shift changes, and protective equipment), what is “reasonable” (e.g., when accommodations are and are not required), ADA restrictions on medical questions and exams, legal pitfalls, and more!
